Terms & Conditions

1. Scope of Services

The Photographer agrees to provide the photography and videography services as specified in the attached Quotation (JD-2026-020). The selected package, add-ons, team composition, coverage hours, and deliverables are as itemised therein. No services outside the Quotation are included unless agreed in writing by both parties.

2. Payment Terms

A non-refundable booking deposit of 25% of the total contracted amount is due upon signing this Agreement and is required to secure the wedding date. The remaining balance of 75% must be paid in full before the wedding day, and no later than at the Photographer’s first attendance or arrival at the event. Accepted payment methods: bank transfer or cash in USD. If payment in Lebanese pounds (LBP) is agreed, the applicable exchange rate on the day of payment applies. The Photographer reserves the right to withhold attendance and delivery of all digital files, videos, prints, and albums until full payment has been received.

3. Cancellation Policy

All cancellations must be submitted in writing. Upon cancellation, the following terms apply:

• 90 or more days before the wedding: Booking deposit is forfeited; no further amounts are owed.

• Within 60 days (2 months) of the wedding: 50% of the total contracted amount is owed, in addition to the forfeited deposit.

4. Rescheduling & Postponement

Weddings postponed to a later date may retain the booking deposit provided the Photographer is available on the new date and the new date is confirmed in writing within 14 days of the postponement notice. Rescheduling to a date that is unavailable to the Photographer will be treated as a cancellation per Clause 3.

5. Copyright & Intellectual Property

All photographs, video footage, edited videos, and other creative works produced under this Agreement remain the exclusive intellectual property of Jose Daou Photography. The Clients are granted a non-exclusive, non-transferable licence for personal, non-commercial use (family sharing, personal social media, personal printing). Any commercial use, publication, or sale of the images or footage requires prior written consent from the Photographer. Any third party (supplier, venue, florist, etc.) reproducing or reposting work created by Jose Daou must credit and tag @josedaou.

6. Delivery Timeline

Estimated delivery times from the wedding date:

• Trailer: within 4–6 weeks

• Edited photos (soft copy) & raw files on HDD: within 6–8 weeks

• Summary video / Full video: within 8–12 weeks

• Printed photos & albums: within 4–6 weeks of the Clients’ confirmed photo selection

Photo selection for printing: The Clients are responsible for submitting their photo selection to the Photographer. The Clients have a maximum of 2 years from the wedding date to submit their selection for printed photos and albums. After this period, any unsubmitted print selections are considered waived and the Photographer is under no obligation to produce prints or albums.

Rush delivery (if selected as a paid add-on) reduces photo and video delivery to approximately 2 weeks. Delivery timelines are estimates and may be affected by post-production volume.

7. File Retention & Data Responsibility

The Clients are solely responsible for maintaining their own backup copies of all delivered digital files from the moment of delivery. From 1 year after the wedding date, Jose Daou Photography assumes no responsibility and accepts no liability for any data loss, file corruption, or unavailability of raw files, edited photographs, or video footage. As a courtesy, the Photographer will endeavour to retain files for a maximum of 3 years from the wedding date; however, this retention is not guaranteed beyond the 1-year mark and is subject to storage capacity and operational circumstances. After 3 years, all files may be permanently deleted without notice. No refunds or compensation will be issued for files lost or deleted after the 1-year responsibility period has elapsed.

8. Coverage Arrangements

Full details of the wedding day schedule must be agreed in writing before the event. The Photographer must be notified of any changes no later than 14 days before the wedding. Coverage begins and ends at the times specified in the Quotation. The Photographer cannot be held liable for missed moments resulting from schedule deviations communicated less than 24 hours in advance.

9. Portfolio & Promotional Use

The Clients grant the Photographer the right to display images and footage from the wedding for portfolio, website, social media, advertising, and editorial purposes. Should the Clients prefer that their images not be used publicly, they must notify the Photographer in writing before the wedding date.

10. Colour Accuracy & Venue Restrictions

The Photographer will provide a pleasing colour balance; however, exact colour reproduction cannot be guaranteed due to lighting conditions or reflective materials. At certain venues, the Photographer’s movement may be restricted by officiants or venue management. The Photographer accepts no responsibility for obstructed coverage caused by such restrictions.

11. Retouching & Reorders

All delivered images are adjusted for exposure, brightness, contrast, and sharpness. Creative retouching, digital manipulation, and artistic finishing beyond standard adjustments are available as an optional extra at additional cost. All print reorders must be submitted in writing; no responsibility for errors in verbal or informal orders.

12. Limitation of Liability

The Photographer’s total liability under this Agreement shall not exceed the total amount paid by the Clients. In the event of technical failure, data loss, or other circumstances beyond the Photographer’s reasonable control resulting in partial or total loss of material, the Photographer’s obligation shall be limited to a proportional refund of fees paid. The Photographer maintains backup equipment and follows best practices for data redundancy.

13. Force Majeure & Substitute Photographer

Neither party shall be in breach of this Agreement for failure to perform due to circumstances beyond reasonable control, including natural disaster, civil unrest, government restriction, or pandemic. In the unlikely event that the assigned Photographer is unable to attend due to unforeseen personal circumstances, the Photographer reserves the right to appoint a qualified substitute photographer on the Client’s behalf. The Clients will be notified as soon as possible.

14. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Republic of Lebanon. Any disputes shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Lebanon.

15. Entire Agreement

This Agreement together with the attached Quotation constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or understandings. Any amendment must be made in writing and signed by both parties.
